1. Introduction

Welcome to Diamond Shotcrete. These Terms and Conditions ("Terms") govern all services provided by Diamond Shotcrete, LLC (“Company,” “we,” “us,” or “our”) to our clients (“Client,” “you,” or “your”). By hiring us or using any of our services, you agree to be bound by these Terms.

2. Scope of Services

Diamond Shotcrete specializes in shotcrete, concrete placement, structural reinforcement, and related construction services. The specific services to be provided will be outlined in individual project proposals, bids, or contracts.

3. Estimates and Proposals

All quotes and proposals are valid for 30 days unless stated otherwise. Prices are based on the project scope, material availability, labor costs, and other relevant factors. Changes in project scope may result in adjustments to cost and timeline.

4. Payments

  • A deposit or mobilization fee may be required before work begins.

  • Payment terms will be specified in your contract or invoice. Typically, progress payments are required on larger projects.

  • Late payments may be subject to a late fee of 1.5% per month or the maximum allowed by Arizona law.

  • Final payment is due upon substantial completion unless otherwise agreed in writing.

5. Project Timeline

We strive to complete projects in a timely and professional manner. However, weather, unforeseen site conditions, permitting delays, and material shortages may affect the timeline. Diamond Shotcrete is not liable for delays outside our control.

6. Permits and Approvals

Unless otherwise agreed, the client is responsible for obtaining any necessary permits, inspections, or approvals required for the project. We will assist when required and possible, but final responsibility rests with the property owner.

7. Site Access and Safety

The client agrees to provide reasonable access to the job site during standard working hours. The site must be clear and safe for our crew and equipment. Any delays caused by lack of access may result in additional charges.

8. Warranties

We provide a limited warranty for workmanship on completed projects for a period of one (1) year from the date of substantial completion. This does not cover damage due to misuse, normal wear and tear, third-party work, or acts of nature.

9. Change Orders

All changes to the original scope of work must be submitted in writing and approved by both parties. Additional costs and timeline impacts will be discussed and agreed upon prior to execution.

10. Liability and Insurance

Diamond Shotcrete is licensed, bonded, and insured in the State of Arizona. We carry general liability and workers’ compensation insurance. However, we are not liable for incidental or consequential damages beyond the cost of the contracted work.

11. Termination

Either party may terminate the agreement for cause, including breach of contract. In the event of termination, the client shall pay for all work completed and materials ordered up to the termination date.

12. Dispute Resolution

In the event of a dispute, both parties agree to attempt resolution through informal negotiations. If unresolved, the matter may be submitted to mediation or arbitration in Maricopa County, Arizona, before pursuing legal action.

13. Governing Law

These Terms are governed by the laws of the State of Arizona. Any legal action shall be filed in a court of competent jurisdiction in Maricopa County.

14. Modifications

Diamond Shotcrete reserves the right to update these Terms at any time. Changes will be posted on our website and become effective upon posting.
